The EU Succession Regulation (Regulation no 650/2012) sets out a unitary regime applicable to cross-border succession cases as it deals with the whole estate and does not make a differentiation between types of property: moveable and immovable property. At the same time, the Regulation provides uniform rules regarding jurisdiction, applicable law, recognition, and enforcement, also establishing the European Certificate of Succession.
This course aims to provide an exhaustive analysis of the Succession Regulation in light of European Court of Justice judgments about this instrument. Following the structure of the Succession Regulation, it dedicates one session for each part of this instrument, from its jurisdictional regime to the European Certificate of Succession.
