The Position

Gilead Sciences Ltd. is seeking a Legal Business Partner to join the Legal team within the Italian commercial affiliate, based in Milan. This is an exciting role offering a broad and evolving practice with high visibility and direct support responsibilities for one or more therapeutic areas in the business. The role reports to the Legal Senior Director and is part of a team managing a high volume of legal and business conduct (compliance) support on a range of issues often with tight deadlines, which will require a responsive, hands-on mentality and approach.

Job duties

Support the Legal Senior Director with other members of the Legal team to ensure comprehensive support for the Affiliate’s Business Units, Market Access team, Commercial Operations and functional departments on all legal and business conduct matters, with an analytical approach, strong attention to detail, excellent drafting, negotiation and communication skills.

The lawyer will give substantive legal advice to one or more of Gilead’s Business Units and cross functional teams supporting the activities of the Business Unit(s) on sales and marketing strategies, medical educational activities, public affairs, patient group and community activities as well as policy and government affairs initiatives.

In addition this role will have a focus on supporting the compliance program for the Italian Affiliate, also with regard to Gilead’s Business Conduct Manual and Farmindustria Code of Practice (and underpinning Italian and EU laws), Transparency, FCPA and Anti-Bribery.

Legal Responsibility

  • Lead on strategic legal/business conduct advice and operational support for at least one key Business Unit and other departments in the Italian affiliate, including, but not limited to:
    • Supply, distribution and procurement processes;
    • Promotion and product launch planning/implementation;
    • Contract generation and negotiation;
    • Competition law;
    • Anti-corruption process review and implementation;
    • Development and delivery of legal training program;
    • Business Conduct Responsibility.
  • This will include leading on strategic business conduct operational support for the UK/I affiliate and provision of related legal and business conduct advice as required, including:
    • Overseeing ACE Business Conduct SOP implementation, training and compliance at Affiliate level;
    • Collaborating with Business Conduct teams from other areas of the organization on Business Conduct projects and SOP and training development;
    • Overseeing business conduct compliance by the Italian Affiliate in its interactions with HCPs, community and decision makers, including sales, marketing, medical education, community and payer interactions;
    • Supporting the Italian Affiliate (across all therapeutic teams and functions) on business conduct matters including advice on points of interpretation of SOPs and required internal approval processes;
    • Being primary point of contact for support to one or more Business Units;
    • Tracking business conduct issues, and identifying appropriate corrective actions and close-out including process enhancement and addressing identified training needs;
    • Overseeing FCPA and UK Bribery Act compliance by developing procedures and delivering training (in collaboration with EAME/Global Business Conduct and Senior Counsel, Anti-Corruption in FC);
    • Overseeing business conduct compliance of grants and sponsorship processes (including supporting Fellowship programs/Community Grants);
    • Ensuring high degree of integration and understanding of context in which business conduct policies and SOPs operate at an Affiliate level and identifies areas of potential risk;
    • Contributing to the ongoing auditing of corporate and commercial compliance policies and procedures to ensure they appropriately fulfill Gilead Legal and Business Conduct requirements. Supports periodic Business Conduct audits and conducts interim monitoring though job bag audits;
    • Supporting business conduct investigations and works with Business Conduct Advisors to appropriately escalate where necessary;
    • Overseeing Affiliate-level HCP spend tracking procedures and compliance with local transparency and disclosure requirements;
    • Contributing to multidisciplinary and/or International projects, leads Business Conduct projects, and takes responsibility for Business Conduct aspects of projects;
    • Working collaboratively with other legal and BC teams within the wider Gilead organization;
    • At all times bringing good judgment and common sense and offering practical legal solutions to challenges Gilead is facing.

Knowledge, Experience and Skills

  • We are seeking a lawyer with solid 4+ PQE experience providing legal counsel on the laws and regulations relating to pharmaceuticals (preferably both in-house and in private practice).
