Position Summary

Bristol-Myers Squibb is seeking a Senior Counsel to join our Innovation Law Group and Intellectual Property (IP) Commercial Team, reporting to the Head of IP Europe. The role will be located in our Steinhausen office in Switzerland.

Having applicable experience in prosecution and litigation, the Senior Counsel will assist in the development, implementation, and execution of IP strategies to provide strong protection for our products and product candidates in the European markets and in other geographies.

This position requires the appointee to work in close collaboration with members of the Global Innovation Law; Litigation and Commercial Law & Compliance Groups and other stakeholders, and requires the appointee to build strong client relationships to provide IP advice to a variety of clients across the company.

This commercially oriented position has a direct influence and impact for the IP strategy and practice in some of the major markets for the company.

Key Responsibilities

  • Provide IP counselling and support to various stakeholders on patent, regulatory data exclusivity, and other IP issues;
  • Collaborate with other law department colleagues and functional support groups to provide legal advice and counsel relating to IP;
  • Proactively monitor, review and contribute to European IP assets related to strategic products and technologies, through in-depth IP expertise and market knowledge;
  • Advise on the preparation and prosecution of PCT filings and European patent applications;
  • Manage and support key IP activities in Europe, including contributing to IP disputes, legal proceedings, EP oppositions & prosecution strategies;
  • Direct outside counsel in litigation, prosecution and other legal services;
  • Provide IP direction and support in commercial agreements, including evaluation of licensing opportunities or other strategic transactions, and inter-company agreements;
  • Foster an IP culture and develop, implement, and provide IP trainings to BMS business units.

Qualification & Experience

  • Bachelor’s degree or equivalent in the biological sciences with an advanced degree and/or scientific research experience in life sciences, with a focus in antibody, vaccine and/or cell therapy technologies;
  • Fully qualified European Patent Attorney;
  • A law degree or patent litigation experience;
  • Relevant biotechnology patent experience at a law firm or in-house legal department of a corporation, preferably with a law firm;
  • The candidate must be fluent in both written and spoken English; at least one other EPO official language would be an asset;
  • Excellent analytical, written, and verbal communication skills, with an ability to convert IP legal issues into readily understandable business issues;
  • Well-developed research and critical thinking skills, and sound decision-making abilities, with attention-to-detail to produce consistently accurate work;
  • Service-oriented focus with ability to work independently as well as part of cross-functional teams and drive results;
  • A positive attitude, the ability to work across business functions with teams in multiple time zones;
  • Highest integrity, excellent judgment and the ability to proactively recognize and effectively assess business risk and communicate legal issues to patent, legal and general management;
  • Domestic and international travels when required.
